With the deadline, approaching in April, for convicted R Allen Stanford to file a Petition for a Writ of Certiorari to the United States Supreme Court, the convicted Ponzi schemer applied for an extension of time, on February 24, 2106.
The Court, speaking through Justice Thomas, granted his request; the time to file his Petition has been extended Until June 6, 2106. This news serves to answer those who have wondered whether Stanford, whose sentence is not up until the next century, will continue to seek relief. The Fifth Circuit Court of Appeals have affirmed his conviction & lengthy sentence.
If you have not been following the Stanford cases, former Stanford Executives Gilbert T Lopez, and Mark J Kuhrt are both seeking to have their convictions reviewed by the high court. Their counsel has asserted that the trial judge erred on jury instructions; the Fifth Circuit affirmed the convictions, and 20-year sentences.
The Supreme Court petitions were filed on the grounds of Conflict Certiorari, meaning that two or more of the Circuit Courts of Appeal have disagreed upon the same issue; it is a means of getting the Court to accept jurisdiction, to resolve the split between the courts.
