CHINA ALLOWS BO XILAI TO APPEAL HIS CORRUPTION CONVICTION

 

In a strange twist of events, China yesterday announced that it was allowing the controversial leader, Bo Xilai, to appeal his corruption conviction.

 

Since China does not follow the rule of law, and court rulings are generally based upon what the Communist Party of China dictates, the outcome is all but certain; his conviction will be affirmed, but there is more to this than meets the eye.

 

Is allowing Bo Xilai to appeal an acknowledgement of the power of China's corrupt PEPs, even when one of them is facing a long prison term ? The Bo Xilai trial was supposed to send a message to senior PEPs, that corruption would no longer be tolerated, and that those who continue would face severe penalties, but giving him the right to file a cosmetic appeal saves him face, and affirms his power.

 

By this act, China demonstrates that it does not yet have the political resolve to dismantle its system of utterly corrupt PEPs, who become wealthy, at the expense of foreign companies seeking to enter the large Chinese market.

 

The PEPs demand bribes and kickbacks, which violate Western laws on corruption, and expose foreign companies, and their staff, to criminal charges at home, even when they have no actual involvement in the payments.

 

Expect no real reform, which means more problems for Western businesses in China, and therefore higher risk. When will China rein in its corrupt PEP culture ?

ARRESTED CORRUPT CHINESE PEPS HAD VILLA IN FRANCE, MANAGED BY MURDERED BRITISH BUSINESSMAN NEIL HEYWOOD

The evidence regarding a €2m villa in Cannes confirms that the owners were Gu Kaili, convicted of the murder of British Businessman Neil Heywood, and her husband, Bo Xilai, a senior Chinese government official now under arrest, and charged with bribery amounting to ten million Yuan, embezzlement and abuse of power, in a major corruption scandal that the Government of China sought to minimize while in the midst of a change of leadership.

The  French corporation that owned the villa was reportedly controlled by two firms in Luxembourg, and one must assume this was for the express purpose of concealing beneficial ownership.

The individuals managing the property were, successively: The French architect who lived with Gu Kailai in the UK, Neil Heywood, and finally a British national of Chinese origin, who is linked to the son of the PEP couple, Bo Guagua.

One wonders what over valuable assets Bo Xilai and his lawyer wife, Gu Kailai, purchased through straw buyers, outside the Peoples' Republic of China, and how many years he will receive in prison for his corruption.

Assuming that most senior Chinese PEPs are squirreling away bribery and kickback funds overseas, can you really risk banking Chinese PEPs in the EU ? I seriously doubt it.

CHILDREN OF CHINESE PEPS, MANAGE DADDY'S DIRTY MONEY.

WHERE IN THE US IS BO GUAGUA AND DOES HE HAVE HIS PARENTS' DIRTY MONEY ?

Now that Gu Kailai, the rising Chinese politician, has finally be charged with corruption, the question remains: does his son, Bo Gua Gua, have his illicit wealth, and is it being banked in the Boston area ? Bo was reportedly a participant in the Boston Marathon, and he did attend Harvard.

There's no news from China on the seizure of Gu's millions, and his attorney wife probably was able to move much of it out of China, so which American bank has it ?

The compliance problem is that Bo Gua Gua probably has a number of valid passports, all with aliases, and his bankers may not even know who he is.

Many children of Chinese PEPs attend university in the United States under well-established aliases, so that their classmates, and the media, do not know who they are.

Their fellow students might not take kindly to the presence of the child of a major human rights violator, or multi-millionaire "public servant." Many universities actually cooperate with this charade.

Additionally, the tuition is often far more than their family legally earns, so you can easily figure out their involvement in corruption in China. Bo Gia Gua, a well known playboy in both the UK and the US, was notorious for his night life, the cost of which was substantial.

So, here is his photo; who is the banker who is attending to his every need, even though his attorney mother was convicted of murdering a British businessman, and his father stands accused of corruption ? And why is this person, having now completed his education in the US, and probably holding a substantial amount of dirty money, allow to live in America indefinitely ?

A reader who was working in the field, on a temporary assignment, reports that, when he attempted to access this blog, using a Chinese IP address, he learnt that China is blocking the website.

I don't know whether to be angry or not, but I have published a number of unfavorable stories about

(1) corrupt Chinese PEPs

(2) China's heavy-handed takeover of the South China Sea, and

(3) the college-age children of corrupt Chinese PEPs, going to universities in America, and using aliases, with the institutions' permission, to prevent them from being identified by other students as "princelings."

 I believe Chinese Government censorship means that I must be doing something right.

HONG KONG A SOURCE FOR DETAILS ABOUT CORRUPT CHINESE PEPS

It is a given that one cannot obtain any objective information about the activities of prominent Chinese, including the country's  PEPs, due to the total and complete censorship and control that China maintains over its domestic media. If you, as a compliance officer, were requested to conduct an accurate and complete due diligence investigation of a Chinese PEP for account opening purpose, Internet news, and postings, would not tell you whether the individual is corrupt, or has a history of acts in office that would cause you to recommend that they not be served as a client. So, what are you to do ?

Buried in a recent article about Hong Kong is the answer: when mainland Chinese wish to lean the dirt about their public servants, they journey to Hong Kong, where freedom of the press remains relatively intact, due the former British Territory's degree of autonomy, and pick up magazine and books published there, and overseas, in Chinese, that detail the many sins of the country's corrupt PEPs. Reportedly, many Chinese attempt to smuggle those extremely damaging works home, when they return.

Therefore, should you have significant new account business with Chinese nationals, it is suggested that you secure a local firm, to act as information resource, in Hong Kong, for these purposes:

(1) To determine whether a specific prospective Chinese client is a Politically Exposed Person (PEP).

(2) To determine whether the individual, or his entities, have been the subject of negative information, in Hong media, or book published outside China, and exactly what that information is.

(3) To confirm that Chinese clients are not, in truth and in fact, actually military or government staff, who are concealing their true occupations or professions.

 It is strongly suggested that, should the business support it, you engage an individual, inside your Compliance department, with the appropriate linguistic skill, to  review the material you receive, for accuracy and relevancy.

China is a black hole for the negative information that you must have to judge the suitability of these potential clients, and you now have an avenue for your enquiries.
