El Paso man sentenced to 20 years in federal prison for receiving, distributing child pornography

EL PASO, Texas — An El Paso man was sentenced Friday to 20 years in prison for receiving and distributing child pornography.

This sentence resulted from an investigation by U.S. Immigration and Custom Enforcement's (ICE) Homeland Security Investigations (HSI).

David Aaron Diaz, 35, was also sentenced to 10 years of supervised release after he completes his prison term.

On Sept. 15, 2015, Diaz pleaded guilty to receiving and distributing child pornography. By pleading guilty, Diaz admitted that he received and was in possession of pictures containing images of children being sexually exploited. Diaz had more than 130,000 files containing child pornography in his possession.

Diaz has remained in federal custody since HSI special agents assigned to HSI El Paso Cyber Crimes Group arrested him April 10, 2015.

"This sentence serves as a reminder of the gravity of this crime," said Waldemar Rodriguez, special agent in charge of HSI El Paso. "It’s also a testament to the dedicated HSI special agents who aggressively investigate these pedophiles, bring them out of the shadows, and ensure they receive the punishment they deserve.”

U.S. Attorney Ian Hanna, Western District of Texas, prosecuted this case.

This investigation was conducted under HSI's Operation Predator, an international initiative to protect children from sexual predators. 

Since the launch of Operation Predator in 2003, HSI has arrested more than 14,000 individuals for crimes against children, including the production and distribution of online child pornography, traveling overseas for sex with minors, and sex trafficking of children. In fiscal year 2015, nearly 2,400 individuals were arrested by HSI special agents under this initiative and more than 1,000 victims identified or rescued.

South Texas man sentenced to 20 years in federal prison for producing child pornography with his own young relatives

MCALLEN, Texas — A South Texas man was sentenced Friday for producing child pornography by sexually exploiting his own young relatives.
This sentence was announced by U.S. Attorney Kenneth Magidson, Southern District of Texas. This investigation was conducted by U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI).

Raul Casarez, 35, from Weslaco, Texas, was sentenced March 4 by Chief U.S. District Judge Ricardo H. Hinojosa to 20 years in federal prison, which will be immediately followed by five years of supervised release. The court also ordered a total of $9,500 in restitution for all of the identified victims in this case. Additionally, Casarez will be ordered to register as a sex offender for the rest of his life. Casarez pleaded guilty to the charges Sept. 21, 2010.

According to court documents, at a previous hearing, the court heard testimony concerning the family relationship Casarez had to the victims that he sexually exploited to produce child pornography. Testimony established that Casarez sexually exploited four young relatives that considered him to be the "fun" relative. Furthermore, the court heard how the defendant had preyed on his younger relatives for several years dating back to the mid-1990s up until his arrest in 2009.

On Sept. 30, 2009, an HSI special agent began an Internet investigation to identify persons using peer-to peer file-sharing software to traffic in child pornography.  The special agent soon discovered a specific computer as offering to distribute child pornography movies. Casarez was identified as the person linked to that computer.

HSI special agents executed a search warrant at Casarez’s residence and seized computers and various external storage media.  Forensic examination of the seized items revealed more than 4,000 images and more than 400 movies of child pornography involving obviously young children engaged in sexually explicit conduct. The images included children under the age of 12 involved in bondage and acts of violence. Some of the images are of known victims as identified through the National Center for Missing and Exploited Children.

Casarez admitted he downloaded child pornography from the Internet and that he possessed it on his computer. The forensic examination also revealed three photographs or visual depictions of a young pre-pubescent girl stored on the computer's hard drive. The photographs depicted her in a pose considered to be sexually explicit conduct.

The pictures were taken by a Samsung cell phone and uploaded to Casarez's computer.

KAVIN CARTER SENTENCED TO MORE THAN 16 YEARS FOR SEX TRAFFICKING

Florida man sentenced to more than 16 years for sex trafficking

TAMPA, Fla. — A Florida man was sentenced to 16 years in prison Monday for sex trafficking of a minor by force, fraud or coercion and ordered to pay a $10,000 fine. This case was investigated by U.S. Immigration and Customs Enforcement’s (ICE) Homeland Security Investigations (HSI), the Florida Department of Law Enforcement and the Lakeland Police Department.

According to the plea agreement, in October 2012 law enforcement officers received information on Kavin Carter, 40, of Lake City, related to human trafficking activities in Lakeland and Lake City.

Law enforcement identified another man, Michael Gallon, 50, of Lakeland, as a “pimp” who was operating in Florida and the southeastern United States. Gallon recruited adult and minor females to join his “dance team.” He then transported the girls to bachelor parties and house parties that he had arranged. The females danced and performed acts of prostitution at these parties.

Gallon partnered with Carter, who co-hosted parties at his home. Gallon transported the girls, almost every weekend, to Carter’s residence in Lake City. Carter and Gallon set up “VIP” rooms at the parties, and they encouraged the females to engage in commercial sex acts. They charged the women to use these “VIP” rooms and kept most of the money the women had earned. Law enforcement has identified at least 12 minor victims of Gallon’s offenses, and most of these girls engaged in commercial sex acts at Carter’s home.

“We cannot undo the horrific crimes against the young victims, but this sentence will ensure this criminal cannot cause additional harm,” said Susan L. McCormick, special agent in charge of HSI Tampa. “The hard work of HSI special agents and the Lakeland Police Department have brought this predator to justice and made our local communities a safer place.”
Michael Gallon, 50, of Lakeland, previously pleaded guilty for his role in this case. On May 29, 2014, he was sentenced to 33 years and nine months’ imprisonment for sex trafficking of a minor by force, fraud or coercion and a concurrent term of 20 years in federal prison for distributing child pornography. Carter pleaded guilty Nov. 24, 2014.
