THE COURT WON'T GIVE A NEW TRIAL TO PONZI SCHEMER

FROM THE - JOURNALS of Monte Friesner – Criminal & Intelligence Analyst and Consulaire for WANTED SA   ~Contributed & Written by Kenneth Rijock ~

FEDERAL JUDGE REFUSES TO GIVE NEW TRIAL TO CONVICTED CHECK CASHER, NOTWITHSTANDING THAT PONZI SCHEMER WITNESS LIED ON THE STAND

The US Government apparently, at times, uses Ponzi schemers to make other cases. Juan Rene Caro*, whose money service business, La Bamba Check Cashers, illegally assisted construction companies in evading payroll and social Security taxes, and mandatory insurance, through the adroit use of shell companies, is currently serving eighteen years in Federal Prison, for CTR violations involving $132m.The construction companies paid their illegal alien workers. through checks payable to shell companies, which Caro's company cashed, thereby evading Federal tax withholding, and insurance payments, on the laborers. Caro's conviction was affirmed on appeal.

His attorney then asked for a new trial. The grounds: one of the principal witnesses against him at trial lied on the stand. Who was this person ? master Ponzi schemer Nevin Shapiro, now serving his own prison term of twenty years, on charges that include money laundering, for his $930m operation.

Caro's attorney moved for a new trial, based upon these grounds:

(1) Shapiro, who borrowed money from Caro to repay illegal gambling debts, committed perjury at Caro's trial, when he testified that he was in the grocery brokerage business, when in truth and in fact, he was running a Ponzi scheme. Shapiro currently owes $82m, as and for Restitution.

(2) Shapiro was actually under Federal investigation in New Jersey, for his Ponzi scheme activities. the US Attorney in Miami denied that his office knew about the New Jersey investigation, and therefore did not disclose it to Cano's attorney, in violation of Brady** and possibly Giglio***.

The Court denied the motion, even though the Ponzi schemer advised the court, in a letter, that he had committed perjury.

*Case No.: 08-cr-20444 (SD FLA).
** The prosecutor is obligated to disclose, to the defense, any information that might affect the credibility of a witness, or be favorable to the accused. Brady vs. Maryland.
*** The prosecutor is required to disclose, to the defense, any information about arrangements, with the witness, involving immunity, or other similar favorable treatment, to be received in exchange for his testimony. Giglio vs. United States. Did Shapiro derive a benefit from his testimony ?

LAWYERS, KEEP AN EYE ON YOUR CLIENTS SuSPICIOUS ACTIVITIES.

FROM THE - JOURNALS of Monte Friesner – Criminal & Intelligence Analyst and Consulaire for WANTED SA

~Contributed & Written by Kenneth Rijock ~

SUITS AGAINST LAWYERS FOR PONZI SCHEME CAN EXPOSE PERSONAL INFORMATION ON PROFESSIONALS

The pending lawsuit, against a prominent law firm that advised convicted Ponzi schemer Nevin Shapiro, illustrates the possible consequences when lawyers fail to identify their client as a Ponzi early on, and exit the relationship. We have previously covered this litigation in a prior article, but a new, and more professionally disturbing, development recently appeared.
Counsel for the plaintiff, a victim who sues the Ponzi's law firm on several causes of action, asked the Court for the performance reviews, personnel files, and sundry other extremely personal professional information about the attorneys who advised their client, who is now serving an extended term in Federal Prison for his crimes.
Though the judge denied these requests, the point remains: when lawyers unwittingly advise Ponzi schemers, and do not learn about their client's true purpose until it's too late, they risk being placed under a microscope in subsequent litigation against them by the victims.
That is just one more reason to always periodically review your clients for suspicious activity, irrespective of your profession.

UNIVERSITY OF MIAMI IN A BIG TROUBLE !

FROM THE - JOURNALS of Monte Friesner – Criminal & Intelligence Analyst and Consulaire for WANTED SA ~ Contributed & Written by Kenneth Rijock

PONZI SCHEMER'S IMPROPER DONATIONS PUT UNIVERSITY IN HOT WATER

Nevin Shapiro at UM sports event Remember convicted Ponzi schemer Nevin Shapiro, currently serving a 20-year sentence for his $930m  fraud ? Well, whilst Shapiro was fleecing his victims, he was a major contributor to the University of Miami's athletic programme.

The problem is, some of his "contributions" were improper or illegal; they were made directly to the players, and not to the university.

A gambler who reportedly lost $9m betting on games, Shapiro was allegedly looking for inside information to help him place winning bets, and he has alleged that the coaches supplied him with that knowledge.

The many illegal financial benefits that he bestowed upon the university's football and basketball players, which ultimately came to the attention of the body that regulates intercollegiate athletics, and the university faces sanctions; it has already lost face, due to the unflattering media coverage.
From Federal Prison, the Ponzi schemer is looking for any opportunity to reduce his sentence, and he frankly does not care who he maligns or damages, to get there.

Any nonprofit organization that accepts donations should always check out its donors carefully. Should the donor have any major problems, he may be inclined to supply information damaging to the nonprofit, if he has any, to obtain an advantage in his criminal proceeding. In this case, he had some to deliver; if you are banking a nonprofit, you may want to obtain assurances that its compliance department checks out its donors before accepting gifts.
